Why Hire The Jefferson Firm? Confidentiality and Complete Counsel


Why hire a tax attorney instead of a CPA, Enrolled Agent, or Tax Preparer for representation?  There are two primary reasons for doing so and they are client confidentiality and complete counsel.  It is only with a tax attorney that you have the very important "attorney-client privilege" relating to confidentiality concerning communications.  The "federally authorized tax practitioner" privilege under Internal Revenue Code Section 7525 protections discussions only in civil matters.  If a case becomes a criminal tax matter, the privilege is no longer applicable. Additionally, only attorneys are legally exempt from being forced to testify against clients should the IRS prosecute the client criminally.  On the other hand, a CPA, Enrolled Agent, or Tax Preparer can be forced to testify.

Only a tax attorney can communicate all of a client's options, including legal options such as tax bankruptcy.  A CPA, Enrolled Agent, or Tax Preparer may not give legal advice. Lastly, it just makes sense to have an attorney working on your behalf since the IRS or State have attorneys working for them.
